Seller agreement
When you submit a listing to IronHead™and check the "seller agreement" acknowledgement, you confirm the representations, warranties, and obligations below. These run alongside the auction rules.
Effective 2026-08-261Ownership and authority to sell
You represent that you own the vehicle or part described in the listing, or that you have the authority of the registered owner to list it for sale. The platform does not independently verify ownership or title; the seller affirms ownership at the moment of submission.
If you list on behalf of a partnership, estate, family trust, lending institution, or auction house, you additionally represent that you have the documentary authority to transfer title to the winning bidder.
2Title status
You agree to disclose the title status accurately. The platform offers six enumerated titles (clean / salvage / rebuilt / lien / missing / in transit) plus a free-text "other" fallback. Selecting the wrong title status — even if the listing sells — is treated as a material misrepresentation and is cause for post-sale remedy, including removal of the sale.
You are responsible for meeting your jurisdiction's title-branding and disclosure laws (for example, U.S. federal odometer disclosure on 1981-and-later vehicles, EU type-approval requirements on certain imports). The platform does not warrant that any title you hold is registrable in the buyer's jurisdiction; that is a buyer-side due-diligence step covered on the buyer disclosures page.
3Mileage and condition disclosure
You agree to disclose the odometer reading honestly and to the best of your knowledge. If the reading is unknown, not actual, or may have rolled over, do not enter a numeric value — write "unknown" or "exempt" in the listing description. The platform does not independently verify mileage; the seller's representation is the warranty.
You agree to disclose known mechanical condition honestly — running / non-running / partially disassembled / parts-only — and to flag any materially significant defect (frame damage, bent fork, stripped mainshaft, holed engine case) in the description or by photo.
4Provenance, photos, and intellectual property
Your photos must be of the actual motorcycle or part, not stock photography or reproduction shots from a third-party listing. You retain ownership of the photos you upload; you grant the platform a non-exclusive licence to display them in connection with the listing, the auction page, and the auction archive.
Your listing description must be original or used with permission. Re-pasting another marketplace's listing copy without the right to do so is cause for listing removal and account review.
5Fees and manual settlement
IronHead™ charges a per-listing tier fee. The fee is non-refundable once the draft is submitted for curator review, except where the curator rejects the draft before it goes live. The current fee schedule is on the auction pricing page; placeholder rates in this document are superseded by the live schedule.
On a successful sale, IronHead coordinates the buyer and seller steps manually. No buyer sale funds are collected through the auction flow, no seller payout account is required, and no settlement is confirmed until an administrator records that coordination.
Settlement timing is coordinated directly by IronHead after the auction and logistics steps. The account status page records whether manual settlement is pending or confirmed.
6Removal rights
The platform may remove a listing that violates these representations, that is reported for fraud or duplicate cross-listing, or that the curator review surface flags during moderator sweep. Removal after the auction goes live is rare and limited to material misrepresentation, fraud, or unlawful activity.
7Indemnification and dispute cooperation
You agree to cooperate in good faith with the dispute resolution process if the buyer opens a ticket — including providing documentation (service records, original photos, prior-owner information, shipping receipts) on request. Failure to cooperate may result in forfeiture of the seller's commission on the disputed transaction.
You agree to indemnify the platform against third-party claims arising from a misrepresentation you made in the listing — most commonly a mileage or title-status misstatement. The indemnity is capped at the gross proceeds of the disputed sale except where a non-excludable remedy in your jurisdiction expands it.
8Platform role
The platform is not a dealer, not an auctioneer under any statutory regime that requires one, and not the warrantor of any listing's accuracy. We are the marketplace and the marketplace coordinator for the listing and the buyer/seller handoff. No buyer sale funds are collected through the auction flow, and manual settlement is not confirmed until an administrator records that coordination.
Effective date: 2026-08-26. This document is informational and has not been reviewed by qualified counsel. Items about jurisdiction-specific disclosure laws (US federal odometer, EU type-approval, state-level salvage-titling rules), warranty wording in foreign-language marketplaces, and the enforceability of indemnity caps require professional legal review before this text can be relied on as a binding contract.
